Local 21 of the International Longshore and Warehouse Union is filing a “charge for recall” against Cowlitz County Sheriff Mark Nelson, claiming malfeasance, misfeasance and violation of his oath of office. The union filed the “charge for recall” yesterday morning, and in the seven page filing, the ILWU contends that Nelson is violating his oath by failing to protect Cowlitz County citizens, failing to serve without discrimination or bias, failing to abide by all laws, and failing to honor the Constitution. The union makes a number of claims; they say that Nelson has been wasting taxpayer dollars, failed to arrest a wanted person, based on the identity and affiliation of the victim, and violation of civil rights, along with other contentions. The filing was made yesterday morning at the Auditor’s Office, and will be forwarded to the County Prosecutor. The Prosecutor’s office will forward the charge to a Superior Court Judge, who will then determine if there’s a legal basis to go forward. If the judge determined that the claim is valid, then the ILWU will need to collect enough signatures to put the recall on the ballot.
